Before you select a tenancy agreement to use for your tenant you need to know: 

• The type of tenancy involved (as different tenancy types need different forms), and
• The type of  tenancy agreement you want – for example, are you going to rent a room in a shared house, will the rent be inclusive of bills, will there be guarantors etc

Note that the rules on tenancy agreements will change slightly after the Renters Rights Act 2025 comes into force.  In particular:

• Tenancy agreements will be mandatory, and landlords can be fined if they don’t provide one
• Tenancy agreements will need to include government ‘prescribed clauses’ (not available at the time of writing)

Granting a tenancy to a tenant is a significant act.  Not only are you effectively losing control of your property (which is why you need to be careful who you let to).  But there are also a number of procedures that need to be followed at this time.  Failure to do this can result in fines and penalties.

We have quite a few different tenancy agreement templates, which members can create using our document generator system.  When creating the tenancy agreements there are also a number of options (such as whether to include guarantors, how the bills are to be paid etc).

The tenancy agreements provided are:

• A ‘bog standard’ AST – versions for England and for Wales
• An AST for a room in a shared house (suitable for HMOs) – versions for England and Wales
• A resident landlord tenancy agreement
• A Company let agreement

Our tenancy agreements will be updated when the new prescribed clauses which need to be included under the Renters Rights Act 2025 have been published.

As well as the tenancy agreement forms themselves, there are a number of other forms which members can use.  These are: 

• Two versions of our guarantee form (one of them a ‘guarantor friendly version)
• A renewal form – to use to renew the tenancy at the end of the term (note that this will be rendered obsolete by the Renters Rights Act)
• A pet’s permission form – if you decide to allow your tenant to keep a pet
• A home business permission form – if you decide to allow your tenant to run a business from the property, and
• A lodger permission form – if you decide to allow your tenant to sublet to a lodger.

In Wales, different rules apply along with different terminology.  All landlords must serve a ‘written statement’ of the ‘occupation contract’ or face financial penalties.
